<p class="wp-block-paragraph">The Colorado River Compact turns 100 this year, but any celebration is damped down by the drying-up of the big reservoirs it enabled. The Bureau of Reclamation’s “first-ever” shortage declaration on the river acknowledges officially what we’ve known for years: the Compact and all the measures augmenting it, collectively known as The Law of the River, have not prevented the river’s over-development.</p> <p class="wp-block-paragraph">Nearly every pronouncement from the water establishment about the centennial of the Colorado River Compact calls it the “foundation,” “the cornerstone” of the Law of the River – as though before the Compact was adopted, the river was lawless.</p> <p class="wp-block-paragraph">It wasn’t. The real foundation of the Law of the River is the appropriation doctrine that all seven river basin states embraced from their start, an evolving body of common law foundational to all water development in the arid American West.</p> <p class="wp-block-paragraph">There is much to appreciate in the appropriation doctrine. It allows water to be claimed only by those who are actually putting it to beneficial use, thus precluding speculation. It protects existing downstream users from having their supply dried up by new upstream users. It has shown flexibility in incorporating new uses.</p> <p class="wp-block-paragraph">But the appropriation doctrine also evolved as a powerful engine for growth. Its “first in time, first in right” promise of perpetual secure use rewards those who get to the water first.</p> <p class="wp-block-paragraph">Judicial decisions then increased its potential for spurring growth. The abstract “right to use water” came to be a <em>property right</em> that could be bought and sold like an automobile, and water whose <em>use</em> was so purchased could then be moved anywhere – along with its seniority. This enabled cities and other large entities with concentrated economic power to buy and move water far from its origin, including water they were not yet ready to use, which clashed with the appropriation doctrine’s anti-speculation intent.</p> <p class="wp-block-paragraph">The Colorado River Compact commission came together 100 years ago to impose some control on that growth engine. The seven Basin states had finally acknowledged that they would have to honor each other’s prior appropriations, and they knew that could precipitate a chaotic seven-state horse race, with each state trying to appropriate as much water as possible as quickly as possible.</p> <p class="wp-block-paragraph">Their initial strategy was to prevent that by determining what each state could “equitably” use. That failed because the cumulative sum of what they each believed they deserved added up to considerably more than the river’s average flow.</p> <p class="wp-block-paragraph">Finally, they just divided the seven-state horserace into three-state and four-state horse races, details to be worked out later, and that became the essence of the Compact. It wasn’t quite what they had set out to do, but it satisfied the federal government enough to allow Reclamation’s eager beavers to begin developing the river’s mainstem.</p> <p class="wp-block-paragraph">The Compact and subsequent laws, agreements, contracts and other measures we know as The Law of the River impose public priorities on the Upper and Lower Basins, limit water for California, designate water for Mexico, add recreation as a beneficial use, incorporate environmental restrictions, limit California again, construct shell games with reservoirs, et cetera.</p> <p class="wp-block-paragraph">But a good question for evaluating the Compact and the Law of the River today is this: Would the situation on the Colorado River today have been any worse, or different, had there been no Colorado River Compact and its augmenting “Law of the River”?</p> <p class="wp-block-paragraph">Given that the desert empire watered by the Colorado River continues to grow virtually unchecked, with 50 to 80 percent more growth anticipated by mid-century, even as the water supply shrinks four to five percent for every degree of temperature increase, it may be time to stop trying to construct control systems around the growth engine, and look into the engine itself.</p> <p class="wp-block-paragraph">This is, of course, something no one wants to touch. <p class="wp-block-paragraph">Seven Western states and their leaders — all depending on water from the Colorado River — remain divided.&nbsp;</p> <p class="wp-block-paragraph">Split into basins by an imaginary border at Lees Ferry, Arizona, each state can share blame for the rapid depletion of reservoirs that once held over four years’ flow of the Colorado River. But now, Lake Powell and Lake Mead edge closer to empty. With water savings gone, the Lower Basin has been trying to cope, though the Upper Basin carries on business as usual. Meanwhile, 40 millions Americans depend on flows from this over-diverted river.</p> <p class="wp-block-paragraph">So far, leaders in the Upper Basin states of Colorado, New Mexico, Utah and Wyoming appear to be hoping that their counterparts will agree to use less water. This is hardly a useful strategy and seems a lot like a dangerous game of chicken.</p> <p class="wp-block-paragraph">The brunt of low flows has been borne by the Lower Basin states of Arizona, Nevada and California. Thanks to a series of agreements between 2007 and 2021, by the end of this year the three states will curtail their river use by more than 1 million acre-feet — 325 billion gallons. But it’s likely these cuts won’t change much.</p> <p class="wp-block-paragraph">Federal data released last month predict that Lake Mead, the largest reservoir in the nation and the Lower Basin’s water savings account, will continue to lose water for years to come. Lake Powell, the Upper Basin’s savings account, is also vulnerable. But that raises the obvious question: What are Colorado, Wyoming, Utah and New Mexico doing to limit their water use and conserve? The answer is not much.</p> <p class="wp-block-paragraph">In the Upper Basin’s four states there are no self-imposed curtailments of Colorado River allocations — no blockbuster, big-city conservation initiatives, no real signs that leaders are convinced that climate change is not only happening but also a major threat to the region.</p> <p class="wp-block-paragraph">More discouraging is that in 2016, the interstate collective of Upper Basin officials, known as the Upper Colorado River Commission, officially decided to <a href="https://coloradosun.com/2021/03/01/colorado-river-planning-drought-demand-estimates/">take more water</a> out of the river. That decision stands today.</p> <p class="wp-block-paragraph">Some of the largest projects on the Upper Basin’s wish list include the Lake Powell Pipeline, Green River Block Exchange, Wolf Creek Reservoir, and the Fontenelle Dam expansion. These proposed projects would drain billions of gallons from the system, reports the nonprofit Save the Colorado.</p> <p class="wp-block-paragraph">Does anyone think that extra water exists?</p> <p class="wp-block-paragraph">The Bureau of Reclamation, which manages the Colorado River’s infrastructure, <a href="http://www.riversimulator.org/24month/2022.02.pdf">released a report</a> in mid-February that predicts Lake Mead will drop another 30 feet by the end of 2023 –– leaving the reservoir 160 feet lower than in the year 2000. It also predicts more cuts for Nevada’s and Arizona’s shares of the river, as well as for California.</p> <p class="wp-block-paragraph">In the Upper Basin, where the Colorado River begins, no cuts are proposed. And according to a <a href="https://utahrivers.org/blog-post/2021/12/13/new-report-upper-basin-states-overusing-colorado-river-water">new report</a> from the Utah River’s Council, a nonprofit fiscal and water watchdog, most of the Upper Basin states continue to use more than their share of the river, even though drought and aridity have reduced river flows.</p> <p class="wp-block-paragraph">While the three Lower Basin states use more water than the drought-stricken Colorado can deliver annually, leaders in Arizona, Nevada and California share a spirit of sacrifice when it comes to limiting water use. From my experience running a nonprofit river-protection group, I know that collaboration toward these efforts represents a resolve to act.</p> <p class="wp-block-paragraph">The Lower Basin states, for example, are working to fund a water-recycling facility near Los Angeles. The plant would reduce California’s reliance on the Colorado River and give Nevada and Arizona some of that river water in return for their joint funding. Collaborations like this need to start happening in the Upper Basin, but where are the examples?</p> <p class="wp-block-paragraph">Water managers in both basins tell folks they are doing their best to deal with the river’s decline, but only the Lower Basin’s actions can be quantified. It’s time for the Upper Basin to blink in this game of chicken and ensure equitable and prudent uses of the river. <p class="wp-block-paragraph">It feels like an apocalypse in the Southwest — wildfires, floods, drought, heat, smoke. This was not the norm when I moved to Colorado 35 years ago. Climate scientists may have predicted the arrival of these extreme events, but many admit their predictions have come true faster than they expected.</p> <p class="wp-block-paragraph">One outcome they pinpointed was the impact of heat and drought on water flows in the Colorado River. For the last 20 years this new climate, combined with booming human population growth, has parched landscapes, drained reservoirs and incited talk of water wars across the region. Lake Powell on the Colorado River, and Glen Canyon Dam which creates the reservoir, have become casualties of this strained environment.</p> <p class="wp-block-paragraph">Lake Powell is the second largest reservoir in the United States, but in the last year alone its water level&nbsp; has dropped 52 feet and the reservoir now sits at 31.4% full.</p> <p class="wp-block-paragraph">If you’re a pessimist, that’s over 68% empty. Water managers are already imposing cuts in water deliveries in some states; all their choices are filled with political pitfalls.</p> <p class="wp-block-paragraph">A further complication is that the federal government operates a hydroelectric plant at Glen Canyon Dam that provides cheap electricity to parts of the Southwest. The day is coming when the hydroelectric turbines will stop for want of water to spin them.</p> <p class="wp-block-paragraph">To save the lake and generate electricity, the government needs water. But where will that water come from?</p> <p class="wp-block-paragraph">Upstream of Lake Powell, in Utah, Colorado, Wyoming and New Mexico are millions of acres of irrigated farms and ranches that suck massive amounts of water out of the Colorado River before it reaches Lake Powell. If those farms and ranches quit taking water and instead ran that water downstream, the lake and its electricity could be saved. To ensure that outcome, the federal government has hatched a plan it calls “demand management,” which proposes to buy or lease massive amounts of farm and ranch water to prop up Lake Powell.</p> <p class="wp-block-paragraph">On the one hand, the farmers and ranchers would get paid for the water, and likely paid very well. If I were a rancher who owned water, I’d sit comfortably until the offering price for my water made me even more comfortable.</p> <p class="wp-block-paragraph">On the other hand, lots of people and businesses believe that irrigated farming, ranching and outdoor recreation are not only central to the region’s economy, but also to its culture. Should that economy — and the soul of the Southwest — be sacrificed to save a manmade reservoir and its hydroelectricity?</p> <p class="wp-block-paragraph">I’m torn by this dilemma. If farms and ranches are dried up, more water flows down the river. More water in the river benefits fish and the environment. But there’s another solution: We can save farms and ranches and instead drain Lake Powell, freeing the Colorado River to flow free through 169 miles of a drowned and beautiful place called Glen Canyon.</p> <p class="wp-block-paragraph">There’s always the “save hydroelectricity” argument, but it’s a red herring. There are other ways to generate electricity, including wind and solar. In fact, if you’ve ever stood near Glen Canyon Dam and its hydropower plant, you can’t help noticing that it’s surrounded by millions of acres of dry, sun-drenched landscape that would make a great place for a solar electricity farm.</p> <p class="wp-block-paragraph">Electricity can be replaced; farms and ranches cannot.</p> <p class="wp-block-paragraph">As we grapple with these tradeoffs, it’s important to remember that even lower water flows are projected for the future, plus more severe heat and drought that will become the “new normal” for the Colorado River and the entire region. Lake Oroville, California’s second largest reservoir, now has inactive hydro turbines because there’s not enough water to turn them, its dusty lakebed a harbinger of what’s to come for Lake Powell.</p> <p class="wp-block-paragraph">Let’s also remember that Glen Canyon Dam was finished in 1963 and it and Lake Powell are only 58 years old. The region lived without them before, and it can live without them again.
